Acceptance

By submitting the application and confirming you’re over 18, you agree to the terms of this Agreement. The application is part of the Agreement.

Prospective partners will need to fill out the form above or send their proposals to [email protected].

MadMarket will decide if your application is approved, and the decision is final. You’ll be notified by email if successful, with instructions on adding the Links to your site.

To use MadMarket odds/prices on your site, you’ll need a MadMarket customer account to access the API. If you don’t have one, sign up at MadMarket.com.

Promoting the MadMarket Sites

You must:

• Display MadMarket’s provided Links clearly and without alteration.
• Allow MadMarket to monitor your site for compliance and notify them of significant changes.
• Promote MadMarket responsibly, especially regarding vulnerable persons and under-18s.
• Follow MadMarket’s marketing guidelines and approved methods.
• Clarify that your communications with potential customers are independent of MadMarket.

You must not:

• Place Links on unapproved sites, offer incentives, modify Links, or interfere with MadMarket’s transactions.
• Mislead users about your relationship with MadMarket or inflate commissions.
• Promote MadMarket in Restricted Territories or target users likely to abuse promotions.
• MadMarket reserves the right to withhold payments or terminate the agreement if you violate any terms. You can only operate one affiliate account and may be audited for compliance.

MadMarket’s Obligations

MadMarket will provide Links in various formats, possibly including a unique affiliate ID (“AffId”). The ID may change for specific campaigns. MadMarket will try to ensure that customers referred through your Links are identified as originating from your site, but is not liable if this fails, especially if tracking consent is not obtained or privacy laws are violated.

MadMarket will handle any personal data you provide in line with data protection laws. If you’ve self-excluded with  MadMarket in the past, your information will only be used for that purpose.

Payments, Money Laundering, & Your Identity

Customers are visitors from your site who register and bet on the agreed MadMarket products. MadMarket pays you a percentage of the “Net Revenue” generated by these customers, depending on your selected Commission Option (Revenue Share, Bounty Payment, or Hybrid Payment). You can change your payment option once per month, subject to MadMarket’s approval.

MadMarket will provide monthly statements, and payments will be made at the end of each month. Any overpayments will be corrected by MadMarket. Inactive accounts may incur fees, and MadMarket may terminate affiliates who fail to deliver new customers.

You must comply with all relevant laws, including anti-money laundering, data protection, and anti-bribery regulations. MadMarket may verify your identity and request supporting documents. Any personal data or VAT information provided must be accurate, and you remain responsible for your tax obligations.

MadMarket also reserves the right to terminate agreements for breaches of gambling commission requirements or improper marketing practices.

Errors

MadMarket strives to avoid errors in calculating affiliate payments but acknowledges that human, system, or third-party mistakes can happen. If an error occurs, MadMarket reserves the right to correct or void payments, including seeking reimbursement for overpayments.

If you receive an incorrect payment, it is your responsibility to notify MadMarket promptly and cooperate to resolve the issue. MadMarket may also offset any overpayment against future payments.

Fraud

MadMarket reserves the right to take legal action if you are suspected of fraudulent or criminal behavior and may report such activities to authorities. MadMarket is committed to responsible gambling, ensuring fairness, protecting vulnerable individuals, and preventing crime. You agree not to act in ways that conflict with these goals. MadMarket may suspend or terminate accounts involved in illegal activities, withhold funds, and report details to authorities as necessary.

MadMarket also reserves the right to withhold or remove any commissions associated with transactions deemed fraudulent. If a customer is identified as fraudulent, any earned commissions linked to that customer may be reversed or deducted from the affiliate’s account balance. The determination of fraud is at the sole discretion of the Company, based on a range of factors including, but not limited to, payment disputes, chargebacks, or violations of terms of service.

License to Marks

You are granted a non-exclusive, non-transferable, revocable license to use MadMarket’s intellectual property (such as logos or trademarks) solely during the term of this Agreement and only for approved promotions. You may not sub-license or transfer this license without MadMarket’s consent, and it will automatically end if the Agreement is terminated.

You must not challenge MadMarket’s rights to the Marks, nor register any trademarks or domain names that resemble MadMarket’s intellectual property. You also agree to cooperate in protecting the Marks from third-party infringement.

Additional Warranties

Each party confirms it has the authority to enter this Agreement and grant the rights and licenses specified. You are responsible for your Site’s operation and content, ensuring it contains no defamatory, unlawful, harmful, or otherwise objectionable material, and does not link to such content. We are not liable for third-party claims related to your Site, and you will indemnify us for any related losses.

You affirm that you are of legal gambling age as per your jurisdiction; affiliates under 18 cannot participate. You also agree not to disparage MadMarket or its affiliates or engage in any actions deemed unsuitable or fraudulent.

Indemnity and Liability

You shall indemnify MadMarket for any losses, claims, damages, costs, or liabilities incurred due to your breach of this Agreement. This indemnity includes consequential losses, legal costs, and applicable VAT.

Neither party’s liability for death, personal injury, or breach of indemnities is limited. MadMarket is not liable for any loss of business, revenue, profits, or data, nor for indirect or consequential losses.

We are not liable for losses due to events beyond our control, such as acts of God, power failures, or government actions. We are not responsible for disputes between you and users of your Site.

Termination

This Agreement begins on the date MadMarket notifies you of your successful application to the affiliate program and continues until terminated per this clause.

Either party may terminate immediately with written notice if the other party is subject to bankruptcy, liquidation, or similar processes, or if a receiver is appointed over its assets.

MadMarket may also suspend or terminate the Agreement upon notice if you materially breach any term and fail to remedy it within the specified period, or if you breach any warranties. In such cases, MadMarket can withhold any amounts due to you.
MadMarket may terminate immediately if you are deemed unsuitable as an affiliate without needing to disclose the reasoning.

Either party can terminate with seven (7) days’ written notice. Termination does not affect any rights accrued prior to this. Upon termination, you must remove all MadMarket links, marks, and content from your Site, and all rights and licenses granted will cease.

MadMarket may deduct any outstanding debts from payments due to you, and you will not receive any commissions from customers generated after termination.

General

This Agreement, including your application form, constitutes the entire agreement between the parties, superseding all prior agreements. You may not assign or subcontract your rights or obligations without MadMarket’s prior written consent.

Delays or forbearance in enforcing any terms do not waive any rights under this Agreement. If any provision is found to be void or unenforceable, the remaining provisions will continue to apply.

Notices to MadMarket should be submitted via the form above or sent to [email protected], while MadMarket will send notices to the email provided in your application.

You may receive confidential information from MadMarket and agree not to disclose or misuse it without prior written consent, using it only for this Agreement’s purposes. Your obligations regarding confidentiality survive termination, and you will indemnify MadMarket for any related losses.
